What varies by state is whether your state also gives you a credit on your state tax return, usually calculated as a percentage of whatever federal EITC you qualify for. State legislatures change these rates fairly often, so always confirm the current rate on your state's own tax site before filing.

North Dakota residents can still claim the full federal Earned Income Tax Credit — there just isn't an additional state-level credit stacked on top of it the way there is in some other states. This is unrelated to whether North Dakota has a state income tax at all; some no-income-tax states simply have nothing to attach a credit to.
